Terms of Service

1. Introduction
Welcome to Book'n ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of our pet care booking software platform available at booknbuddy.com and related services (the "Service").
By registering for, accessing, or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.
Important: Book'n is a software platform that connects pet care businesses with their customers. We do not provide pet care services directly. Individual pet care businesses are responsible for their own services, agreements, and liability.
2. Definitions
- "Business User" - Pet care businesses (kennels, daycares, groomers, trainers, etc.) that use our platform to manage bookings
- "Customer User" - Pet owners who book services through businesses using our platform
- "Pet" - Any animal registered on our platform for care services
- "Booking" - A reservation for pet care services made through our platform
3. Account Registration
3.1 Eligibility
You must be at least 18 years old and capable of forming a binding contract to use our Service. By registering, you represent that all information provided is accurate and complete.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized access.
3.3 Business Verification
Business Users may be required to provide verification of their business operations, licensing, and insurance as applicable to their jurisdiction.
4. Service Description
Book'n provides:
- Online booking and scheduling tools for boarding, daycare, grooming, training, board & train, dog walking, pet sitting, pet visits, dental, and facility rental services
- Calendar, capacity, suite/kennel management, and availability controls
- Customer relationship management (customer profiles, pet profiles, approval status)
- Invoicing and payment tracking
- Integrated payment processing via Stripe, Square, or Clover (business chooses one)
- In-person card-present payments via Square Terminal or Clover devices (Mini, Flex, Station), and Apple Pay support for online checkouts where supported by the chosen processor
- Saved cards ("card on file") for customers, via Square's Customer vault or Clover's customer record
- Deposit collection and refund handling
- Walk-in retail point-of-sale ("Till"), inventory catalog sync with Square or Clover, and scanner-based retail checkout
- Package sales (e.g. 10-day daycare passes) and credit redemption
- Browser push notifications and transactional email (booking confirmations, reminders, receipts, daily updates)
- Daily update photos and grooming-ready alerts
- Electronic liability waivers and consent captures
- Incident reporting
- Reporting and analytics
Disclaimer: Book'n is a software tool only. We do not:
- Provide, guarantee, or insure pet care services
- Employ or control pet care providers
- Guarantee the quality, safety, or legality of services
- Administer medications, feedings, or treatments (Business Users do so based on instructions provided by the Customer)
- Guarantee uptime or delivery of push notifications or SMS codes
- Verify the credentials of Business Users beyond basic registration
5. For Business Users
5.1 Your Responsibilities
As a Business User, you agree to:
- Maintain appropriate business licenses and permits
- Carry adequate liability insurance for your services
- Provide safe and appropriate care for all pets
- Create and enforce your own service agreements with customers
- Comply with all applicable laws and regulations
- Accurately represent your services and pricing
- Respond promptly to booking requests and customer inquiries
- Complete onboarding with the payment processor you choose (Stripe Connect or Square Connect) and remain in good standing with that processor's terms
- Administer any medications, feedings, or special care only in accordance with the written instructions provided by the pet owner and your own professional judgment — Book'n does not validate or verify medication instructions
- Collect and remit any applicable sales tax, GST/HST, PST on retail sales processed through the Till point-of-sale feature
- Follow all terms of use and safety instructions for any Square Terminal hardware you register with your account
- Keep employee codes and permissions up to date and deactivate codes promptly when staff leave
- Honor package credits you sell through the platform until they expire per the package terms you set
5.2 Required Customer Agreements
We strongly recommend that Business Users implement their own:
- Service agreements / terms of service
- Liability waivers and release forms
- Emergency medical authorization forms
- Vaccination and health requirements
- Cancellation and refund policies
5.3 Incident Reporting
Business Users must promptly report any incidents, injuries, or emergencies involving pets in their care through our incident reporting system.
6. For Customer Users (Pet Owners)
6.1 Your Responsibilities
As a Customer User, you agree to:
- Provide accurate information about your pets (health, behavior, needs)
- Ensure pets are current on required vaccinations
- Disclose any known behavioral issues or medical conditions
- Provide emergency contact information
- Review and accept any additional terms required by individual businesses
- Pay for services as agreed with the Business
- Provide accurate and complete instructions for any medications, feedings, or other per-serving add-ons you add to a booking, and confirm that you are authorized (e.g. by a veterinarian where applicable) to direct such administration
- Understand that package credits you purchase are non-refundable beyond the Business's stated policy and are only valid with the Business that sold them
- Sign any liability waivers required by the Business; your electronic signature has the same legal effect as a handwritten one
6.2 Assumption of Risk
You acknowledge that pet care services carry inherent risks including but not limited to:
- Illness or injury during care
- Escape or loss
- Interaction with other animals
- Exposure to parasites or disease
- Stress or behavioral changes
Recommendation: Carefully review each Business's policies, insurance, and service agreements before booking. Ask questions about their safety procedures and emergency protocols.
7. Payments and Fees
7.1 Platform Subscription
Book'n charges Business Users a subscription fee as outlined in our pricing. Beta users receive promotional pricing specified during registration.
7.2 Platform Commission
In addition to the subscription, Book'n charges a transaction-based platform commission on payments collected by Business Users through Stripe Connect, Square Connect, or Clover:
- Stripe Connect — Weekly payout: 1.5% per transaction
- Stripe Connect — Daily payout: 3% per transaction
- Square Connect: 1.5% per transaction (Square's own payout timing applies — typically next business day or the day after, depending on the time of day the payment was processed)
- Clover: Platform commission rate for Clover transactions is disclosed to the Business at the time of Clover connection and reflected on the Business's invoice. Clover's own payout timing applies per the Business's Clover merchant settings.
The commission is deducted at the time of the transaction and reflected on the Business's invoice. The remainder is routed by the chosen processor to the Business's connected bank account per that processor's payout schedule. Standard processor transaction fees (charged by Stripe, Square, or Clover) apply in addition to the Book'n platform commission.
7.3 Payment Processing — Stripe
- Payments are processed through Stripe's PCI-compliant infrastructure
- Business Users choosing Stripe must complete Stripe Connect onboarding and agree to Stripe's Terms of Service
- Stripe's standard transaction fees apply in addition to the Book'n platform commission
7.4 Payment Processing — Square
- Payments are processed through Square's PCI-compliant Web Payments SDK, Square Terminal hardware, or invoice links
- Apple Pay is supported where the Business accepts Square payments online
- Business Users choosing Square must complete Square Connect OAuth and agree to Square's Terms of Service
- Square's standard transaction fees apply in addition to the Book'n platform commission
7.5 Payment Processing — Clover
- Payments are processed through Clover's PCI-compliant Ecommerce API for online charges and through Clover devices (Mini, Flex, Station) for in-person card-present payments
- Business Users choosing Clover must complete Clover OAuth and agree to Clover's Terms of Service and Merchant Agreement
- Clover's standard transaction fees apply in addition to the Book'n platform commission
- Clover device hardware is purchased and supported separately by the Business through Clover or its resellers; Book'n is not responsible for device provisioning, warranty, or support
7.6 Saved Cards ("Card on File")
With your consent, Customer Users' payment cards may be saved to the Business's Square customer vault or Clover customer record (depending on the Business's chosen processor) for future charges (for example, for no-show fees or post-service retail). You control which cards are saved and can remove them from your Account Settings at any time.
7.7 Deposits
Businesses may require non-refundable deposits to confirm bookings. The deposit amount and policy are set by the Business and shown to the Customer at checkout. Deposit collection, refunds, and forfeitures are handled per the Business's own policy.
7.8 Retail / Till Sales
Business Users operating the Till point-of-sale are responsible for collecting and remitting any applicable sales tax, GST/HST, or PST on retail transactions. Book'n records transactions and amounts; the Business is responsible for tax compliance.
7.9 Refunds and Disputes
Refund and cancellation policies are determined by individual Business Users. Service disputes should be resolved directly with the Business. Payment disputes and chargebacks are handled according to the applicable processor's (Stripe, Square, or Clover) dispute resolution process.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Book'n is not liable for any injury, illness, death, or loss of pets during care provided by Business Users
- Book'n is not liable for any damages arising from the actions or omissions of Business Users or Customer Users
- Book'n is not liable for errors or omissions in medication or feeding instructions entered by Customer Users, nor for the administration of those instructions by Business Users
- Book'n is not liable for sales tax collection, remittance, or classification on retail transactions conducted through the Till point-of-sale
- Book'n is not liable for Square Terminal, Clover device, or other payment hardware malfunction; hardware warranties and support are governed by the manufacturer's terms
- Book'n is not liable for missed push notifications or email delivery failures caused by third-party carriers, browser settings, or device configuration
- Book'n is not liable for the accuracy of payment tokenization; Apple Pay and Google Pay tokens are generated and authorized by their respective platforms and processor (Square, Stripe, or Clover)
- Our total liability shall not exceed the fees paid to us in the 12 months preceding any claim
- We are not liable for indirect, incidental, special, or consequential damages
Important: This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise).
9. Indemnification
You agree to indemnify, defend, and hold harmless Book'n, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Pet care services you provide or receive (for Business and Customer Users respectively)
10. Privacy and Data
Your use of our Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
By using our Service, you consent to the collection and use of data as described in our Privacy Policy.
11. Intellectual Property
The Book'n name, logo, and all related marks are trademarks of Book'n. The Service and its original content, features, and functionality are owned by Book'n and protected by copyright, trademark, and other intellectual property laws.
User-uploaded content: Photos of pets uploaded by Customer Users and daily update photos posted by Business Users remain owned by their uploader. By uploading, you grant Book'n a non-exclusive, royalty-free license to store, display, and transmit the content within the Service for the purpose of operating the Service for you and your counterparty.
12. Electronic Signatures
You agree that electronic signatures you apply through the Service (for liability waivers, consent forms, terms acceptance, and similar documents) are legally binding and have the same legal effect as handwritten signatures. We record the signature together with the document version, timestamp, and your IP/device to maintain a reliable record.
13. Termination
We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination:
- Your right to use the Service immediately ceases
- We may delete your data after a reasonable retention period
- Outstanding payment obligations survive termination
14. Changes to Terms
We may modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.
15. Governing Law
These Terms are governed by the laws of the Province of Alberta, Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Calgary, Alberta.
